1. Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of the website at gatherchart.com (the "Site") and the GatherChart text-message program described in Section 3, both operated by Gather Bio, Inc. ("Gather Bio," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. The Site is informational

The Site provides general information about GatherChart and lets you create a GatherChart account. Creating an account does not enroll you in any research study and does not guarantee a spot in any study or cohort. Research studies and other programs, if offered to you, will be governed by separate agreements and consent documents presented at that time.

3. Text messages from GatherChart

GatherChart offers a text-message (SMS) program. Confirming your mobile number with a code we text you does not sign you up for it. If you choose text messages in the GatherChart app and tick the box agreeing to them, you agree to receive recurring automated text messages from GatherChart at your confirmed number. The messages are your conversation with Gather, GatherChart's AI assistant: replies to what you send, the check-ins and reminders you set, a weekly health questionnaire, verification codes, and notices about your account. Gather is an AI, not a person.

• Frequency and cost. Message frequency varies. Message and data rates may apply.
• Help. Reply HELP for help, or email hello@gatherbio.com.
• Stopping. Reply STOP at any time to stop receiving texts. You will receive one message confirming that you have been unsubscribed, and no further texts unless you opt in again.
• Delivery. Mobile carriers are not liable for delayed or undelivered messages. The program is available on major US mobile carriers.
• Your number. Only enroll a mobile number that belongs to you. If you change or give up that number, turn texting off in Settings or tell us at hello@gatherbio.com so your texts do not go to someone else.
• Privacy. Text messages are not end-to-end encrypted and may appear on your phone's lock screen. Our Privacy Policy explains how we handle your number and your messages; we do not share your mobile number or your consent to receive texts with anyone for their marketing.
• Not for emergencies. Texting GatherChart is not a way to get emergency help. If you are having a medical emergency, call 911. If you are thinking about harming yourself, call or text 988.

4. No medical advice

Content on the Site is for general informational purposes only and is not medical advice. Any summaries, trends, or organized records that GatherChart may provide are informational and are not a substitute for professional medical care. Always consult a qualified healthcare provider with questions about a medical condition or about decisions regarding your care.

5. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false information, or using it for any unlawful purpose.

6. Intellectual property

The Site and its content, including text, graphics, logos, and design, are owned by Gather Bio or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our written permission.

7. Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, Gather Bio will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site.

9. Changes to the Site and Terms

We may modify or discontinue the Site at any time. We may also update these Terms from time to time, and we will revise the "Last updated" date above when we do. Continued use of the Site after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
